Federal Rule of Evidence 502 Resource Pages

Federal Rule of Evidence 502 (Attorney-Client Privilege And Work-Product Doctrine) became effective on September 19, 2008. This overview charts how the new rule seeks to resolve some current conflicts in the case law and to promote reduction of the cost of privilege review and production.

Unlike other amendments to the Federal Rules of Evidence, new Federal Rule of Evidence 502 was promulgated through an act of Congress. This Resource Page provides some of the essential legislative materials on the Congressional legislation leading to adoption of the new rule. It also provides links to other sources of information on the legislative process.

Melendez-Diaz v. Massachusetts Resource Pages


The Melendez-Diaz Resource Page provides background and key links on this significant Confrontation Clause case. On June 25, 2009, in a 5 to 4 opinion authored by Justice Antonin Scalia, the Supreme Court held that certificates of forensic analysis are “testimonial” and “the Sixth Amendment does not permit the prosecution to prove its case via ex parte out-of-court affidavits.” Melendez-Diaz v. Massachusetts, 557 U.S. __, 129 S. Ct. 2527 (2009) (No. 07–591).
