Judicial Conference Encourages Preservation Of Internet Materials Cited In Opinions (Part II)

We recently noted that the Judicial Conference of the United States, the policy-making body regarding the administration of the U.S. courts, adopted guidelines for judges to preserve Internet materials cited in court opinions. The guidelines address the digital era problem of citing to Internet information which later becomes unavailable due to a broken link. As previously reported, the Judicial Conference suggests the website material be attached to the opinion and maintained in the Judiciary’s Case Management/Electronic Case Files System. It is generally known that as more information becomes available on the Internet, courts are referring to Internet sources with greater frequently. So what type of Internet-based information are courts relying upon? A snapshot was provided by some circuit librarians who began collecting Internet-cited information as part of a pilot project that led to the Judicial Conference Guidelines. Ironically, a couple of the cited website links were no longer available to be included in the compendiums. The snapshot they provide reveals the type of information cited by the courts.
